Woman sues McDonald’s franchisee for payroll paid via a JP Morgan Chase debit card

She spent her days serving up Happy Meals, but when it came time to get paid, Natalie Gunshannon says a local McDonald’s franchisee gave her an unhappy deal.

The Shavertown McDonald’s forces workers to be paid only one way: with a payroll debit card that burdens workers with hefty fees to obtain their hard-earned cash, according to a lawsuit filed Thursday on behalf of Ms. Gunshannon and other McDonald’s workers.

Ms. Gunshannon, 27, Dallas Twp., and an untold number of current and former employees had no option to receive a traditional paycheck or get paid by direct deposit, she and her attorneys said in the class-action against franchise owners Albert and Carol Mueller of Clarks Summit.

Ms. Gunshannon, who worked at the Shavertown McDonald’s for a month after being hired April 24, refused to activate the payroll card after reviewing the fee structure, quit the job and reached out to an attorney to see if the practice was legal.

Attorney Michael J. Cefalo of West Pittston and his law firm then drafted a class-action lawsuit against the Muellers, who own 15 other McDonald’s locations throughout Northeast Pennsylvania.

The J.P. Morgan Chase payroll card carries fees for nearly every type of transaction, according to the lawsuit, including a $1.50 charge for ATM withdrawals, $5 for over-the-counter cash withdrawals, $1 to check the balance, 75 cents per online bill payment and $10 per month if the card is left inactive for more than three months.

The European Commission (EC) has just released a report by its authoritative international 16-member scientific committee, based on meticulous scientific documentation, confirming excess levels of the naturally occurring Insulin-like Growth Factor-1 (IGF-1) in milk of cows injected with Monsanto’s biotech hormone (Rbgh).

The report concludes that the excess levels of IGF-1 pose serious risks of breast and prostate cancer. “Experimental evidence for an association between IGF-1 and breast and prostate cancer is supported by epidemiological — evidence arising from recently published cohort studies — .”

The report also warns that excess levels of IGF-1 may promote the growth and invasiveness of any cancer by inhibiting programmed self destruction of cancer cells (apoptosis), and that contamination of milk with residues of antibiotics used to treat mastitis in rBGH cows is likely to spread antibiotic resistant infections in the general population. The EC human health report finally emphasized the need for additional investigation of several other potential risks of rBGH milk.

A parallel EC report also warns of serious veterinary risks of rBGH. It may be noted that FDA has ignored such evidence reported in detail by the author in peer reviewed scientific publications over the last decade. The EC warnings are in sharp conflict with the policies of the Food and Drug Administration, largely based on unpublished and confidential Monsanto claims, that hormonal milk is safe.

As seriously, the report raises serious questions on the competence and conflicts of interest of Codex, the WHO organization responsible for setting international food safety standards, which has given an unqualified clean bill of health to rBGH milk. It should further be emphasized that senior FDA officials and industry consultants are members of Codex, which meets in secrecy and relies on unpublished industry assurances of safety. Interlocking relationships between U.S. and Canadian regulatory officials and Codex are matters of critical concern to U.S. consumers and global food safety.

Faced with escalating rates of breast and prostate cancers, besides other avoidable public health hazards, FDA should immediately withdraw its approval of rBGH milk whose sale benefits only Monsanto while posing major public health risks for the entire U.S. population. A Congressional investigation ofFDA’s abdication of responsibility and of its reliance on Codex authority for food safety, analogous to that recently conducted on rBGH milk by the Canadian Parliament, is well Overdue

  • Monsanto brought Agent Orange to the world, a highly toxic, cancer-causing herbicide used in the Vietnam war. Veterans who were exposed to this herbicide have suffered terrible consequences such as rare cancers, skin diseases, multiple sclerosis, birth defects in their children and psychological disorders
  • Monsanto invented polychlorinated biphenyls (PCBs). As you know, genetically engineered (GE) salmon, the first GE animal meant for human consumption, may soon be approved by the Food and Drug Administration. Center for Food Safety, along with Friends of the Earth and a coalition of thirty consumer, food safety, fishing, environmental, sustainable agriculture, parent, public health and animal welfare organizations, has?launched a national campaign to keep GE salmon out of our supermarkets and off our plates.?

Since the FDA has stated that it will likely not require GE fish to be labeled, consumers will have no way of avoiding GE salmon unless companies make clear to consumers where they stand on the issue.??Over the last month, we?ve sent letters to the nation?s top grocery stores, seafood companies, and seafood restaurants?asking them to commit not to sell genetically engineered fish should it come to market. Some of the biggest grocery stores in the U.S. have already replied, stating that they will not sell genetically engineered salmon in their stores, including:?Whole Foods, Trader Joes, Marsh Supermarkets, Aldi, H-E-B, Hy-Vee, and PCC Natural Markets.[1] Seafood companies like?Crown Prince and EcoFishhave also told CFS they will not buy GE salmon. Additionally,?over 400 chefs and restaurants?have pledged not to intentionally purchase, sell, or serve genetically engineered salmon in their restaurants.[2]?But there are a lot more companies yet to sign!

The U.S. Food and Drug Administration (FDA) has proposed the approval of genetically engineered (GE) salmon for commercial use. Now in its final stage of review, the GE fish would be the first transgenic animal to be approved for human consumption. Biotechnology companies are announcing plans to seek approval for other GE fish. Over one million Americans have already submitted comments to FDA opposing approval of these risky GE salmon. We are deeply concerned about the risks to wild salmon populations, sustainable fisheries, the marine environment, and the potential effects to human health from the introduction of GE salmon.
GE salmon threaten marine environments, wild salmon fisheries, and the communities that depend upon them. The risk of transgenic contamination of wild salmon has been raised numerous times by members of the public, scientific and fishing communities, and even Congress. The Monterey Bay Aquarium Seafood Watch Guide opposed the introduction of GE salmon ?due to the inherent environmental risks involved.?

While data on human health impacts of GE fish is sparse, some recent studies have provided cause for concern. Some research has suggested that transgenic fish may be susceptible to more diseases, so the amount of antibiotics given to GE fish may be higher than the amount currently given to farmed fish.

According to a recent poll, 91% of Americans feel FDA should not introduce GE fish into the marketplace. Consumers want to make more sustainable seafood choices, and food companies, restaurants, and supermarkets need to provide them.

We are very concerned about buying unlabeled GE salmon and are looking to food companies and retailers to assure us that they will not carry GE fish. We urge you to take a position not to intentionally purchase, sell, or serve GE salmon or other GE fish, and to make your policy known to consumers.

I think Ron Paul hit the nail on the head in a recent piece he published on Lew Rockwell’s site. Check it out:

Forced lockdown of a city. Militarized police riding tanks in the streets. Door-to-door armed searches without warrant. Families thrown out of their homes at gunpoint to be searched without probable cause. Businesses forced to close. Transport shut down.

These were not the scenes from a military coup in a far off banana republic, but rather the scenes just over a week ago in Boston as the United States got a taste of martial law. The ostensible reason for the military-style takeover of parts of Boston was that the accused perpetrator of a horrific crime was on the loose. The Boston bombing provided the opportunity for the government to turn what should have been a police investigation into a military-style occupation of an American city. This unprecedented move should frighten us as much or more than the attack itself.

Paul also pointed out that the suspect was discovered by a private citizen, and not by “paramilitary troops terrorizing the public”" ?something we should keep in mind the next time they try something like this.

And make no mistake about it, it will happen again.

What took place in Boston set a very unsettling precedent because it detailed, for the entire world to see, that in the United States, your Constitutional and ?civil rights?can become irrelevant at any given moment.

And with crowds of ?Bostonians demonstrating their willingness to have their rights violated in times of crisis “as determined by some group of random bureaucrats” the government got the message that such action is not only acceptable, but desired.

Make no mistake about it; all those folks who have survived brutal communist regimes are looking at this event now as an unsettling reminder of how easy it is to go from free citizen… to commodity slave.

Now, understand I don’t say this in an attempt to scare you or make you feel uneasy. Instead, I write these words in an effort to call your attention to the under-publicized events that are facilitating the end of our once great democracy.

Because as Edmund Burke once said, “All that is necessary for the triumph of evil is that good men do nothing.”

My friends, I have no interest in allowing evil to triumph.
